Eqithra.com Return Policy

This document sets out the terms and conditions for returning products on the Eqithra.com website. Due to the dual nature of the platform, the return rules depend on the type of transaction. It is the User's responsibility to familiarise themselves with the terms and conditions applicable to their specific purchase before completing it.

Definitions:

  • Eqithra E-store: The sales environment where the Seller of the products is Eqithra (Flamicroz OÜ). All transactions made here are subject to the consumer rights applicable in the Republic of Estonia and the European Union, including the 14-day right of withdrawal from the contract.

  • Eqithra Marketplace: A user-to-user sales environment where individuals or companies (Users) can sell and buy products. In these transactions, Eqithra is solely a provider of the technical platform and intermediary service, not a party to the sales contract.

  • Seller: Depending on the location of the transaction on the platform, the Seller is either Eqithra (in the E-store) or another platform User (on the Marketplace).

  • Buyer/User: A natural or legal person who makes a purchase on the Eqithra.com platform.


PART I: Returning Goods Purchased from the Eqithra E-store (Seller: Flamicroz OÜ)

 

This section governs the return conditions for products where Eqithra is the Seller. These rules are drafted in accordance with the Law of Obligations Act (VÕS) of the Republic of Estonia and consumer protection legislation.

 

14-Day Right of Withdrawal

 

A consumer Buyer has the right to withdraw from a sales contract concluded via the e-store without giving any reason within 14 calendar days.[1, 2] The withdrawal period begins from the moment the Buyer or a third party designated by them has taken physical possession of the product.

The purpose of the right of withdrawal is to allow the Buyer to inspect the product and ascertain its suitability in a manner similar to how it would be possible in a physical retail store. If Eqithra has not duly informed the Buyer of their 14-day right of withdrawal, the withdrawal period is extended by 12 months.

 

Submitting a Withdrawal Application and Returning the Goods

 

To withdraw from the contract, the Buyer must submit an unambiguous withdrawal application to Eqithra before the 14-day period expires. This can be done using the standard withdrawal form available on the Eqithra website or by sending a free-form notice to the email address info@eqithra.com.[3]

After submitting the withdrawal application, the goods must be returned without delay, but no later than 14 days from the submission of the application. The returned goods must be complete and securely packaged. It is recommended to use the original product packaging.

 

Costs Associated with Returns

 

In the event of withdrawal from the contract, Eqithra will refund all payments received from the Buyer, including the cost of delivering the goods to the Buyer.[3] If the Buyer chose a more expensive delivery method than the cheapest standard option offered by Eqithra, Eqithra is not obliged to reimburse the cost exceeding that of the standard delivery method.[3]

The direct costs of returning the goods shall be borne by the Buyer.

 

Condition of the Goods and Compensation for Diminished Value

 

The Buyer may inspect the product in a way that is necessary to ascertain its nature, characteristics, and functioning, similar to what is permitted in a physical store.

If the Buyer has used the goods in any way other than what is necessary for inspection or has caused the deterioration of the product or its packaging, the Buyer is liable for the diminished value of the goods. In such a case, Eqithra has the right to deduct a corresponding compensation from the refundable amount. For example:

  • Fashion items and footwear may be tried on indoors but must not be worn outside.

  • Kitchen appliances must not come into contact with food during inspection.

  • Electronic devices may be switched on, but not put into permanent use.

 

Exceptions to the Right of Withdrawal

 

The 14-day right of withdrawal does not apply to the following products :

  • Products made to the Buyer's personal specifications (custom orders).

  • Goods that are liable to deteriorate or expire rapidly.

  • Products in sealed packaging which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (e.g., cosmetics, underwear, headphones, bedding).

  • Audio and video recordings or computer software in a sealed package that has been opened.

 

Refund Procedure

 

Eqithra will refund the amount paid by the Buyer without delay, but no later than 14 days after receiving the withdrawal application.[3] Eqithra has the right to delay the refund until the returned goods have been received at the warehouse and their condition has been checked, or until the Buyer has provided proof of having sent back the goods. The refund will be made to the same payment instrument that the Buyer used for the purchase.[3]


PART II: Resolving Transactions on the Eqithra Marketplace

 

This section describes the rules that apply to transactions on the Eqithra Marketplace, where Eqithra acts as an intermediary, not the Seller.

 

Eqithra's Role and Dispute Resolution

 

On the Marketplace, a sales contract is concluded directly between two Users—the Buyer and the Seller. Eqithra is not a party to this contract and is not responsible for the quality, condition, or delivery of the products sold on the Marketplace.

Attention! As Marketplace transactions are mostly between private individuals, the statutory 14-day right of withdrawal does not apply.

Returning a product is possible only by mutual agreement between the Buyer and the Seller. Eqithra does not mediate returns or resolve disputes between Users. All claims regarding the product's quality, condition, or conformity to the description must be submitted directly to the Seller.


PART III: General Provisions



Right to File a Claim (Defective Product)

 

All products are covered by a 2-year right to file a claim in case of non-conformity (e.g., a manufacturing defect).

  • For the Eqithra E-store: Claims must be submitted directly to Eqithra as the Seller.

  • For the Eqithra Marketplace: Claims must be submitted directly to the Seller (the other User). Eqithra will assist the parties in making contact.

Amendments and Validity

 

Eqithra reserves the right to unilaterally amend these rules. For any given transaction, the rules in force at the time of purchase shall apply.
