This Privacy Policy describes how Flamicroz OÜ (hereinafter "Eqithra", "we", "us", or "platform operator") collects, uses, stores, and protects personal data when you use our web environment at https://eqithra.com (hereinafter "Platform").

Your privacy and data protection are of the utmost importance to us. We are committed to processing your personal data lawfully, transparently, and securely, in accordance with applicable data protection laws, including the European Union's General Data Protection Regulation (GDPR).

2. Purposes and Legal Bases for Processing Personal Data

We collect and process personal data only for specific and legitimate purposes. Below, we describe what data we process and for what purpose in the different parts of our Platform.

2.1. Creating and managing a Platform account

  • Data processed: First and last name, e-mail address, password (in encrypted form).

  • Purpose: To create a user account on the Platform, enable login, and manage the account.

  • Legal basis: Performance of a contract (acceptance of the Terms of Use).

2.2. Data processing in the E-shop (Seller: Flamicroz OÜ)

  • Data processed: Customer's name, contact details (phone, e-mail), delivery address, purchase history, payment data.

  • Purpose: To process orders made in the e-shop, fulfill the sales contract, deliver the goods, prepare invoices, and communicate with the customer regarding the order.

  • Legal basis: Performance of a contract. For accounting-related data, also compliance with a legal obligation (Accounting Act).

2.3. Data processing in the Marketplace (Intermediary: Flamicroz OÜ) In the Marketplace, our role is to provide an intermediation service that allows users to trade with each other. In this context, we have specific data processing purposes.

  • Data processing for service provision:

    • Data processed: Username, contact details, content of sales listings, transaction history, communication with other users via the platform's internal messaging system.

    • Purpose: To ensure the functioning of the Marketplace service, including publishing listings, mediating transactions, and enabling communication between users.

    • Legal basis: Performance of a contract (acceptance of the Terms of Use).

  • Processing of business seller data (in accordance with the DSA):

    • Data processed: Business seller's name, address, phone number, e-mail address, commercial register code.

    • Purpose: To ensure the transparency and reliability of transactions in accordance with the Regulation (EU) 2022/2065 of the European Parliament and of the Council (the Digital Services Act or DSA). Certain data is displayed to the buyer before a transaction is concluded.

    • Legal basis: Compliance with a legal obligation.

  • Collection and reporting of tax-related information (in accordance with DAC7):

    • Data processed: Seller's name and address, personal identification code or business registry code, date of birth (for natural persons), bank account number (IBAN), revenue earned per quarter, number of transactions.

    • Purpose: As a platform operator, we are required by law to collect and report information to the Estonian Tax and Customs Board about sellers who earn income on our marketplace. We do not do this on our own initiative but to fulfill a strict legal obligation arising from the EU Council Directive (EU) 2021/514 (known as DAC7) and the Estonian Act on Exchange of Tax Information. The purpose is to ensure fair tax competition and to help tax authorities verify the correct declaration of income. We emphasize that our role is solely that of an information intermediary.

    • Legal basis: Compliance with a legal obligation.

    • Applicability: The reporting obligation applies to sellers who conduct 30 or more transactions or whose total amount paid exceeds €2,000 within a calendar year.

2.4. Customer support and marketing

  • Data processed: Name, e-mail address, content of communication.

  • Purpose: To respond to your inquiries and questions. If you have given your explicit consent, also to send newsletters and personalized offers.

  • Legal basis: Our legitimate interest in providing quality customer service. For marketing, your consent, which you can withdraw at any time.

3. Transfer of Personal Data to Third Parties

We do not share your personal data with third parties unless it is necessary for providing the service or we have a legal obligation to do so. The processors of your data may include:

  • Payment service providers: For the secure processing of transactions.

  • Transport companies: For the delivery of goods purchased from the e-shop.

  • IT partners: Providers of maintenance and development services for our Platform (e.g., server hosting, software development).

  • Public authorities: As mentioned previously, we transfer data to the Estonian Tax and Customs Board based on a legal obligation (DAC7).

We have entered into agreements with all our partners to ensure that they process data securely and only in accordance with our instructions.

4. Data Retention

We retain your personal data for as long as it is necessary to fulfill the purpose for which it was collected or until legal requirements expire.

  • Accounting-related data is retained for 7 years in accordance with the Accounting Act.

  • Data related to contractual relationships is retained until the expiry of the limitation period for civil claims (generally 3 years).

  • User account data and related information are retained as long as the account is active. Upon account deletion, we will delete data for which we no longer have a legal basis for retention.

5. Your Rights Regarding Personal Data

You have the following rights with respect to your personal data:

  • Right of access: You have the right to know whether and what data we process about you and to receive a copy of it.

  • Right to rectification: You have the right to request the correction of inaccurate or incomplete data.

  • Right to erasure ('right to be forgotten'): You have the right to request the deletion of your data if we no longer have a legal basis to process it.

  • Right to restriction of processing: You have the right, under certain conditions, to request the temporary suspension of the processing of your data.

  • Right to object: You have the right to object to the processing of your data that is based on our legitimate interest.

  • Right to data portability: You have the right to receive the data you have provided to us in a machine-readable format, where the processing is automated and based on a contract or consent.

  • Right to withdraw consent: If the data processing is based on your consent (e.g., newsletters), you have the right to withdraw it at any time.
