EQITHRA HORSES (Marketplace) - Terms of Use
These terms and conditions specifically regulate the "Eqithra Horses" section of the Platform, which is intended for the publication of advertisements for the sale and purchase of live animals (horses and ponies).
1. Nature of the Service and Role of Eqithra
1.1. Notice Board Only:
"Eqithra Horses" operates exclusively as an environment for publishing advertisements. Eqithra is not a party to horse sales contracts, does not act as a broker, and does not evaluate the value or health condition of horses.
1.2. Independence of Transactions:
All negotiations, agreements on veterinary inspections, organization of transport, and financial settlements for the horse take place exclusively between the Seller and the Buyer outside the Platform.
1.3. Exclusion of Liability:
Eqithra is not responsible for the health condition of the horse, hidden defects, compliance with the level of training, temperament, or the correctness of documents. The Seller bears full responsibility for the truthfulness of the published information.
2. Seller's Obligations When Advertising a Horse
2.1. Truthful Information:
The Seller undertakes to publish only truthful and verifiable information about the horse (age, pedigree, health condition, level of training).
2.2. Health and Defects:
The Seller is obliged to honestly disclose in the advertisement all physical or behavioral peculiarities and health problems known to them (including stable vices such as crib-biting or weaving).
2.3. Documents:
The Seller is responsible for ensuring that the horse has proper documents (passport, microchip) and that they have the legal right to transfer ownership of the horse.
2.4. Content Update:
The Seller undertakes to remove the advertisement or mark the horse as "Sold" immediately after the transaction has taken place.
3. Copyright and Media
3.1. Ownership of Content:
The Seller confirms that all photos and videos attached to the advertisement belong to them or that they have the author's permission to use them. It is prohibited to use photos found on the internet without permission.
3.2. License:
By entering an advertisement, the Seller grants Eqithra a free license (simple license) to use the added photos and texts for publishing the advertisement on the Platform and in Eqithra's social media channels (e.g., "Find of the Week" posts).
4. Buyer Recommendations and Security
4.1. Common Sense:
We recommend that the Buyer maintain "healthy skepticism." If an offer seems too good to be true (e.g., suspiciously low price for a top-level horse), it may be a scam.
4.2. Veterinary Inspection:
Eqithra strongly recommends that the Buyer perform an independent veterinary inspection (pre-purchase exam) on the horse before concluding the transaction. Failure to do so is the Buyer's own risk.
4.3. Testing:
We recommend visiting and trying out the horse repeatedly before purchase to ensure its suitability for the rider's level and goals.
5. Data Protection and Prohibited Activities
5.1. Direct Contact:
The Platform is designed for communication between the Seller and the Buyer regarding a specific advertisement.
5.2. Spam:
It is prohibited to use the public contact details (phone, email) of other users to send spam, promotional offers, or other off-topic messages.
5.3. Data Collection:
Automated data collection (scraping) from the Platform without Eqithra's written permission is prohibited.
6. Pricing and Fees
6.1. Basic Service:
Adding and publishing a horse advertisement on the "Eqithra Horses" portal is free by default, unless stated otherwise.
6.2. Additional Services:
Eqithra reserves the right to add paid additional options in the future (e.g., highlighting an advertisement, longer publication period, etc.). Prices for all paid services will be clearly displayed before the service is ordered.
6.3. No Commission:
Eqithra does not take a percentage or commission from the sale price of the horse.
6.4. Refunds:
In the event that a User purchases a paid additional service in the future (e.g., highlighting), the fee is not refundable if the User decides to remove the advertisement themselves before the end of the period or if the item is sold more quickly.
7. Animal Welfare
7.1.
Eqithra does not tolerate animal abuse. It is strictly prohibited to publish photos or videos on the Platform that show abuse of a horse, obviously inappropriate equipment, or horse suffering.
7.2.
Eqithra has the right to remove an advertisement and block a User if there is a reasonable suspicion that the animal being sold has been treated unethically or if the advertisement violates animal protection laws.
